Description

We live in a litigious society, and real estate agents are often exposed to risky situations. We'll discuss identifying risk, correlating our activities with license law and the COE, following good business practices, and learning when to say no to a risky practice.

Learning Objectives for this class: 1. Identify and define misrepresentation and fraud 2. Identify legal (state law), ethical (NAR Code of Ethics), and fiduciary duties in agency relationships 3. Define “reasonable skill and diligence” and apply this concept to their everyday practice 4. Explain how pricing issues become lawsuits. 5. Relate how Federal, State and Local Fair Housing laws and protected classes affect real estate practice. 6. Recognize and avoid steering and inappropriate advertising practices 7. Relate how state law and Code of Ethics escrow requirements apply to everyday practice 8. Describe RESPA and Anti-Trust, and how they impact real estate practice 9. Identify methods and techniques to avoid and shift risk
